Terms and Conditions of Sale
Definitions
The "COMPANY" refers to SWG MOTORSPORT.
The "BUYER" refers to the purchaser of goods.
Summary
The company only accepts orders subject to the conditions of sale to the exclusion of any condition of the buyer.
Payment
Not withstanding delivery, the risk of the goods and the property in the goods shall not pass to the buyer until the goods are paid for in full prior to dispatch.
Prices
Prices of goods supplied as of this date are correct but subject to market fluctuation and revision. Any oversea's orders shall be charged to the buyer at current exchange rates. The company has no control or liability over these rates.
VAT
The company's price list excludes UK sales tax (VAT).
Fitness for purpose
The company is in no way liable for the purpose and fitment of goods supplied to the buyer. The company has no control over the fitment and method of their application or use. The company excludes any condition or warranty implied by statue or otherwise as to the fitness of its goods or any other particular whatsoever. A 12 month guarantee is provided to the original purchaser of the goods against faulty workmanship or materials and this is non transferable to any third party whatsoever.
Liability
The companys liability to the buyer shall at no time exceed the price of the goods supplied. The company shall be under no liability for any direct loss and/or expense or any indirect loss and /or expense suffered by the buyer or liability to third parties incurred by the buyer. The company shall be under no liability whatsoever for any loss or damage whether direct or indirect resulting from the supply of goods. The company shall be under no liability whatsoever for the quality and purpose of goods supplied to a third party who is not the original purchaser.
Delivery
The company shall be under no liability whatsoever for any loss whether direct or indirect resulting from the delay in dispatch or delivery of goods. Goods are normally supplied by the company carriage paid (UK mainland only). The company reserves the right to charge the buyer for any specific or special request on delivery requirements. Delivery outside of the United Kingdom will be charged to the buyer at the discretion of the company. No liability is accepted for any claims for short delivery or damaged goods unless notified to the company in writing within three clear days of delivery.
Returns
Nothing herein shall give the buyer the right to return the goods in part or full to the company outside of the 12 month guarantee period. The company reserves the right to accept or not accept the return of goods for any reason whatsoever. Any goods deemed for return by the company shall be returned carriage paid by the buyer. (Special order items cannot be returned for refund). No variation of these terms and conditions shall be binding upon the company unless in writing and signed by the director on behalf of the company.
THIS CONTRACT IS SUBJECT TO THE LAW OF ENGLAND AND WALES.
